1.1. The Terms and Conditions detailed herein contain the entire contract between the traveller and The Wanderlust (The Wanderlust, Lda), enrolled in the Conservatória do Registo Comercial de Aveiro with the unique registration number and legal person number 513 242 660 and RNAVT Registration No. 4989. No representation, term, warranty or condition may be expressed or implied by reference to any other writing, advertisement or conversation. This agreement can only be changed in writing by a duly authorised official or director of The Wanderlust.
1.2. The Wanderlust is not a carrier, hotel chain, nor own its aircraft or hotels. All reservations with carriers, hotels and other service providers are subject to the terms and conditions and limits of liability imposed by these carriers, hotel chains and other service providers. Some of these limit or exclude liability in the event of death, bodily injury, delay and loss of or damage to the baggage, and we can not accept any responsibility for any loss as a result of such actions or as a result of any act or omission of a third party. However, we will give every possible assistance to help resolve any reasonable dispute.
The Wanderlust cannot be held responsible for the failure of third parties to provide equipment and services for travellers with disabilities (see also point 6 in Details & Travel Conditions).
1.3. The Terms and Conditions detailed here for participation are supplemented by the travel program in which the traveller subscribes, which constitutes the particular conditions of participation in the trip.
1.4. By contracting The Wanderlust, the traveller recognises and accepts all the established Terms and Conditions.
The liability of The Wanderlust is guaranteed by civil liability insurance with the Zurich Insurance Company and the Tourism and Travel Guarantee Fund of Portugal, under the legislation in force.
Upon receipt of payment from the traveller, The Wanderlust books the seat on the selected trip, subject to availability and at our discretion. A contract is made between the traveller and The Wanderlust only after confirmation of the booking by The Wanderlust and written communication thereof.
2.1. The prices shown in the program are based on the costs of the services and exchange rates prevailing at the programming date and are therefore subject to changes (price increase or reduction) resulting from changes in transport costs, such as fuel, scheduled fares and any other cost changes of airlines that are part of the program. The price of the travel plan may also vary due to government action such as changes to the VAT or any imposition of currency change concerning an exchange variation up to 20 days before the date of travel.
2.2. If the increase in question exceeds 8% of the total price of the trip, the provisions of the clause “If The Wanderlust cancels or changes the trip” shall apply.
2.3. In case of reduction of price, The Wanderlust reserves the right to deduct the reimbursement to make to the traveller, the corresponding administrative expenses, that at the request of the traveller will be justified.
3.1. Where, before the beginning of the journey,
a) Accept the proposed amendment;
b) Terminate this contract, without any penalty, being refunded of the amounts paid;
c) Accept an organized trip of substitution proposed by the travel agency and tourism, being refunded in case of difference of price.
3.2. Failure by the traveller to reply within the prescribed period shall entail tacit acceptance of the proposed amendment.
3.3. Termination of the travel contract by The Wanderlust in the above terms only entitles the traveller to full repayment of payments made within a maximum of 14 days after completion of the travel contract.
3.4. The Wanderlust is not responsible for any costs of other travel plans affected by cancellations or change of dates of any trip.
4.1. The information on our website is correct to the best of our knowledge, but we can not guarantee that any item or amenity mentioned will be available especially if we do not have direct control over it.
4.2. The Wanderlust is committed to doing its best, within its standards, in the selection of accommodation, transport and tours to ensure proper use of traveller’s money.
4.3. The Wanderlust continually strives to improve the itineraries and features presented. If any changes may be made, or if circumstances beyond our control lead to changes being made, The Wanderlust reserves the right to change itineraries or to replace accommodations.
All amounts paid to The Wanderlust may be disbursed by us as and when we deem convenient, concerning the services to be provided and/or fees to be spent on the trip selected by the traveller. The payment of 30% or any other amounts related to the trip must be considered as an authorisation for the disbursement thereof as previously mentioned.
1.1. To guarantee the booking, the traveller must pay 30% of the total amount of the trip. The remaining 70% must be paid up to 45 days from the start of the same (60 days for the tour Trans-Siberian Route). Payment is accepted as a portion of this or all of it, only after confirmation of the written booking by The Wanderlust.
1.2. The booking of the trip will be confirmed upon receipt of 30% of the total value of it, which must be done within the periods mentioned after completing the booking form, or the booking will be automatically cancelled.
1.3. Any special meals will only be made according to their requirements when filling out the booking form. The Wanderlust can not guarantee the existence of these, nor assume any responsibility or obligation if the special meal requirements are not fulfilled.
2.1. Payment of the remaining amount must be made no later than 45 days before the start of the trip (60 days for the tour Trans-Siberian Route), which will be indicated on the booking confirmation communicated in writing by The Wanderlust.
2.2. If payment is not made by the date indicated, The Wanderlust will assume that the traveller has cancelled his booking and will apply the cancellation fees following clause 3 below.
2.3. In the case of late bookings, made less than 45 days before the start of the trip, the total amount of the trip must be paid immediately.
2.4. The Wanderlust reserves the right to cancel the booking and apply the appropriate cancellation fees for payments not received according to the periods mentioned above.
3.1 The traveller is free to give up the trip at all times before its commencement, and the notice of cancellation must be made to The Wanderlust as soon as possible in writing.
3.3. Upon receipt of the notice by The Wanderlust, a termination fee will apply, as follows:
3.6. The traveller is also entitled to terminate the travel contract before the commencement of the travel contract without paying any termination fee if there are unavoidable and exceptional circumstances at the place of destination or in its immediate vicinity that substantially affect the performance of the travel contract or the passengers to the destination. The termination of the travel contract in this situation only gives the traveller the right to full repayment of the payments made, without the right to further compensation.
3.7. The Wanderlust will reimburse all payments made, less the termination fee and other expenses that may have existed, within a maximum period of 14 days after the termination of the travel contract.
4.1. If after confirming the booking the traveller wishes to change the trip to an alternative date, he may do so subject to availability as long as the travel date is on our website.
4.2. A fee of € 25 will be applied whenever a review or alteration to the booking is made after it has been confirmed unless the change in question maintains or increases the value of the trip.
4.3. A change of the booking at 45 days from the start of the trip will be treated as a cancellation and normal cancellation fees will be applied (as detailed in section 3) except when the change is to an earlier departure date of equivalent or higher value, in which the fee of € 25 per person will be applied.
5.1 The traveller may transfer his position and be replaced by another person who fulfils all the conditions required for the journey once he informs the Wanderlust in written form for up to seven consecutive days before the scheduled date of departure.
5.2 The assignor and the transferee shall be jointly and severally liable for the payment of the outstanding balance and for the additional charges, charges or costs arising from the assignment, which shall be duly informed and verified by the travel and tourism agency.
6.1. The traveller should carefully read the travel programs, taking into account the items that are included or not in their value. No allowance or refund can be made for meals, lodging, activities, etc. that the traveller chooses not to enjoy, or when museums, shops, etc. are closed. Accommodation facilities may vary from site to site. Meals may differ in the type of confection.
6.2. The Wanderlust strives to provide a safe, enjoyable and memorable trip for all travellers. The Wanderlust welcomes travellers with special needs. However, travellers are advised to note the following:
6.3. The traveller is responsible for all costs and travel arrangements to and from the start and end point of the trip.
6.4. There may be times when The Wanderlust tour leader will have to make decisions of an individual or group interest. The traveller agrees to comply with the authority and decisions of the tour leader, as well as with the laws of the country in which he is travelling. If you do not comply or if, in the opinion of the tour leader, your presence is not compatible with the general enjoyment and well-being of other members of the group or the proper functioning of the journey itself, The Wanderlust reserves the right of not letting you continue on the trip. We do not tolerate the possession or transportation of illegal or restricted substances (drugs). Also, you agree that the other travellers, as well as any tour leader, have the right to travel/work in a secure environment. Any threats to their safety, well-being or inappropriate behaviour on the part of the traveller, whether verbal or physical, will be taken very seriously and may result in the immediate cancellation of your trip. In that case, you will be responsible for your repatriation and related costs, not having any claims against The Wanderlust.
6.5. The traveller is responsible for any costs incurred as a result of damages or extra cleaning fees related to your accommodation. It is advised to immediately report, as soon as detected, any pre-existing damage in the room to the accommodation team in question and/or to the accompanying The Wanderlust tour leader.
6.6. The Wanderlust may, in its sole discretion, refuse or cancel the booking of any traveller who cannot or refuses to comply with The Wanderlust’s Terms and Conditions. The Wanderlust is not responsible for any costs incurred in case a traveller is removed from a trip. Travellers agree not to hold The Wanderlust or any of its partners responsible for all actions taken under these Terms and Conditions.
6.7. Where the traveller occupies a seat in a carriage equipped with a seat belt, service providers or operators, agents or cooperating organizations shall not be liable for any illness, injury or death, or for any loss, damage or accident or incident if the seat belt is not being used at the time of the accident or incident.
6.8. It is the responsibility of the traveller to hold a valid passport (minimum of 6 months after the date of return) and all visas, permits and certificates required for the selected trip, as well as all necessary vaccines and comply with all applicable laws.
6.9. The traveller agrees that The Wanderlust tour leader will take photographs and film during the trip and that they are used in The Wanderlust brochures and/or advertising or publicity material without obtaining any further consent or payment in respect of such photographs and/or videos.
6.10. If the traveller has a complaint about his/her travel, he/she should inform The Wanderlust tour leader during the trip. If the matter is not resolved after the best efforts of the tour leader during the trip, his/her complaint must be made in writing to The Wanderlust as soon as possible after the trip, but within 15 days so that your claim can be investigated. If you do not write within 15 days, your rights under this agreement may be affected. If you choose to write to The Wanderlust via the Internet, you must provide your home address so that The Wanderlust can respond to you in writing.
The Wanderlust trips, except Iran, already include travel insurance. The insurance is adjusted to The Wanderlust travel period, destination and type of activities. If it is in the interest of the traveller, he can also take out additional insurance, which may or may not be purchased from The Wanderlust.
In the case of removal of the traveller from the trip after the start of it due to illness, a medical certificate must be obtained for an insurance claim. No refund will be made for absence on the trip.
International flights to and from the travel destination, airport taxes, passport and visa fees, laundry service, telephone calls, beverages, meals not detailed in itineraries, gratuities, personal items, excess baggage and optional excursions.
Under no circumstances may The Wanderlust be held liable for weather conditions, nor may any travel be cancelled or altered by the traveller at any time, based on weather conditions.
11.1. The luggage is restricted to a reasonable size and a maximum weight of 12 kg plus a small backpack/bag that can go in the transports next to the traveller. The Wanderlust reserves the right to refuse baggage that is too large for travel.
11.2. For trips that include flights as part of the itinerary, it is the responsibility of the traveller to ensure that their baggage does not exceed the size and weight limits imposed by airlines. The Wanderlust is not responsible for any costs incurred for excessive baggage.
11.3. The traveller is obliged to complain to the entity providing the services at the moment of subtraction, deterioration or destruction of luggage.
11.4. The filing of such a complaint will be an essential basis for triggering the responsibility of the agency over the entity providing the service.
12.1. In case of difficulties for the traveller, or if, for reasons beyond his control, he can not finish the trip, The Wanderlust will provide the following assistance:
a) Providing adequate information on health services, local authorities and consular assistance, and
b) Assisting the traveller in carrying out distance communications and finding alternative travel solutions.
12.2 If the difficulty justifying the request for assistance was caused by the traveller deliberately or negligently, The Wanderlust might charge a fee in the amount of the costs incurred as a result of the provision of such assistance.
12.3. If due to unavoidable and exceptional circumstances, the traveller is unable to return, The Wanderlust is responsible for ensuring the necessary accommodation costs, if possible of similar category, for a period of no more than three nights per traveller.
12.4. The above cost limitation does not apply to persons with reduced mobility, to their accompanying persons, to pregnant women or persons requiring specific medical care, once The Wanderlust has been notified of those particular needs at least 48 hours before the beginning of the trip.
In case of insolvency of The Wanderlust the traveller can resort to the Guarantee Fund of Travel and Tourism, and for this to resort to Turismo de Portugal I.P entity responsible for its activation:

The Wanderlust has in place measures of protection for the personal information of booking owned by us. This information will be transmitted to The Wanderlust tour leader and our partners relevant to the operation of the booked trip. The information may also be provided to the public authorities, such as customs or immigration, if required by them, or as required by law. Specific information can also be passed on to the security or credit verification companies. If you travel outside the European Economic Area, data protection controls may not be as demanding as the legal requirements within the EEA. The Wanderlust only passes the travellers information to the people responsible for their travel plans. This applies to any sensitive information that is provided by the traveller, such as details of any disability or dietary/religious needs. (If we can not pass this information on to our partners, whether within the EEA or not, The Wanderlust will not be able to guarantee the reservation. The traveller, when making a reservation, agrees that this information is transmitted to the relevant people for the operation of the trip.)
If the data is transmitted for marketing purposes, the traveller has the right to opt out of future marketing. You also have the right of access to the data owned by The Wanderlust which can be obtained in writing for The Wanderlust, Rua José Estevão, nº83, 2º Drt, 3800-202, Aveiro, Portugal.
